Chapter 7 Bankruptcy
Chapter 7 Bankruptcy is a “fresh start” for debtors, provided for by the United States Constitution. The goal of bankruptcy is the discharge (forgiveness) of debt that brings with it “a new opportunity in life, unhampered by the pressure and discouragement of preexisting debt.” While the right to discharge is not absolute, and certain debts cannot be discharged, Florida law provides several exemptions that allow debtors to keep some non-exempt property.

Banks have to comply with the various local, state, and federal laws when seeking to foreclose on a mortgage. Foreclosure defense ensures that plaintiffs prove all of the essential elements of their cases, while buying the borrower valuable time to seek other remedies, such as loan modification, deeds in lieu of foreclosure, and short sales.
